Britain Rejects Informing Libya by Means Other Than Diplomatic Ones.
Pulbished on:Tripoli, 30 June 2021(Lana) Libyan State Lawsuit Administration said Tuesday they have achieved a procedural victory from the High Court in the UK which over-ruled on June 25 a UK Appeals Court verdict, stipulating that it was permissible to inform Libyan state by means other than the diplomatic way.
‘We feel proud that in collaboration with the law firm Curtis Mallet, we have achieved a procedural victory in the UK on June 25 that overrule the London Appeals Court which decided that it was permissible to inform the Libyan state other than through diplomatic means in view of the exceptional circumstances in which the country is going through, and stipulated that the informing must be conducted through the diplomatic way in line with the states immunities agreement provisions, the Administration said in a statement.
The statement was released following measures taken by the British General Dynamics Co., aimed at recognizing and executing of a ruling it obtained in 2016, which calls on Libyan authorities to pay the sum of 16 million pounds along with interests and expenses.
The statement said ‘Libya has created a precedence at the UK courts from which other countries, particularly those in the third world, can benefit in similar cases.’
The ruling is the second procedural ruling that the Lawsuit Administration, in collaboration with the international law firm, can help entrench new judicial principles, following the ruling by the French Court of Cassation on May 26, by 14 counsels, which admitted for the first time, right of foreigners to oppose a litigation regarding recognition of commercial arbitration rules intended for execution in France.
