HNEC confirms time for lifting force majeure has passed without achieving any significant progress.

Tripoli, 4 September, 2022 (Lana) - The High National Election Commission announced, Sunday, the expiry of the time it demanded to address the bottlenecks and lift the force majeure that prevented the completion of the electoral process, without achieving any significant progress.

 This came in a statement by the Commission in response to the letter of the Presidency of the House of Representatives regarding the expiration of the time period, and the request of a number of candidates for the elections to resume and announce their preliminary lists.

The commission explained that the political and security environment that was formed after the electoral process stopped did not help in dealing with the elements of force majeure, pointing out that the gap of consensus between the political parties widened, and that the division affected the executive authority and the resulting security tensions negatively affected the security situation in Most of the electoral districts, which led to the inability to resume the electoral process within the period requested by HNEC.

The commission added that the decision to halt the electoral process is a (sovereign) decision issued by an independent sovereign body, taken by its council after consulting with the House of Representatives and discussing its technical and legal backgrounds in accordance with Article (34) of Law No. (1) of 2021 regarding the election of the head of state and determining his powers.

The decision to resume the process will only be a sovereign decision that expresses the will of the Libyans and their aspiration for free and fair elections conducive to credible outcomes and contribute to the country's way out from its current crisis.

The commission confirmed that it will work with the House of Representatives to remove that part of the force majeure components, which is represented in the legal requirements of an unseen technical nature that appeared during the implementation of the relevant laws, and will raise its final observations in case of coordination with the judicial authority regarding the mechanism for considering electoral appeals and disputes. In addition to the need to find a legal formula to deal with the judicial rulings in force to stop the implementation of the electoral process.

HNEC indicated that it has taken advanced steps to develop the technical aspects and systems of the electoral process, which will contribute effectively to avoiding many technical and time obstacles that appeared during the implementation of the relevant electoral laws.

The Commission indicated that it still maintains its full readiness to resume the electoral process if the (consensual) political environment is available, and the security conditions are established to engage directly with partners in completing the lifting of the remaining components of force majeure and resuming the implementation process.
