Al-Menfi to Dbeibah: The formation of governments or any amendment to their structure is subject exclusively to what is stipulated in the constitutional references governing the Libyan Political Agreement.

Tripoli, March 3, 2026 (LANA) – Presidential Council Chairman Mohammed Al-Menfi stated that the formation of governments or any changes to their structure are subject exclusively to the provisions of the governing constitutional frameworks, namely the Libyan Political Agreement and its annexes included in the Constitutional Declaration and its amendments.

This came in a letter addressed by Al-Menfi to the Prime Minister of the Government of National Unity, Abdul Hamid Dbeibah, in which he began by noting Dbeibah's intention to conduct a cabinet reshuffle that would include the dismissal of ministers in violation of the Libyan Political Agreement, despite their enjoying the confidence of the legislative authorities, which is derived from and continues to be based on the Libyan Political Agreement.

The head of the Presidential Council attributed his address to his national responsibility to uphold institutional legitimacy and safeguard the supreme interests of the state.

In his address, Al-Menfi stated that, according to established constitutional principles and norms, governments lose their legitimacy and become caretaker governments in two cases: a vote of no confidence, as stipulated by the absent constitutional requirements, or a vacancy in the core cabinet of one-third of the ministers, as per the political agreement, or, at best, half of the approved cabinet.

Al-Menfi clarified that addressing the vacancies resulting from the voluntary resignation of ministers requires broad national consensus, sound legal frameworks, and binding consultations regarding the portfolios of Defense and Foreign Affairs, which currently represent a top national priority for success.

The Presidential Council head's address, a copy of which was received by the Libyan News Agency (LANA), was also sent to the Speaker of the House of Representatives, the President of the High Council of State, the Head of the Audit Bureau, the Head of the Administrative Control Authority, and the Governor of the Central Bank of Libya.
