The High Council of State: The campaigns of doubt targeting the Libyan judiciary, and the Supreme Court in particular, constitute a serious attack on the principle of separation of powers.

Tripoli, January 1, 2026 (LANA) – The High Council of State announced its full and unconditional support for the statement issued by the Supreme Court, affirming that its contents embody a responsible national stance at a pivotal moment, defending the Constitutional Declaration as the supreme legal framework governing public authorities and safeguarding the independence of the judiciary.

The High Council of State stated in a statement issued today, Thursday, that "the systematic campaigns of doubt and political pressure targeting the Libyan judiciary, particularly the Supreme Court, constitute a serious attack on the principle of separation of powers and a blatant violation of the governing constitutional principles, which no legislative or executive authority may infringe upon, circumvent, or reinterpret outside their constitutional framework."

The Council expressed its deep concern regarding the House of Representatives' continued escalation of tensions with the judiciary, its attempts to establish parallel judicial bodies lacking constitutional basis, and its efforts to impose political interpretations on the judiciary's jurisdiction. The Council noted that this reflects a determination to manage the transitional phase unilaterally, undermining the foundations of national consensus, pushing the country toward further division and instability, and threatening to derail the entire political process, according to the statement.

The High Council of State affirmed that the House of Representatives, as a temporary legislative body with limited powers as established by constitutional jurisprudence, possesses no constitutional authority to redefine legitimacy, override the Constitutional Declaration, or... Challenging the jurisdiction of the judiciary, and continuing down this path, poses a direct threat to the unity of the state and effectively returns Libya to the initial state of division.

The High Council of State called on the United Nations Support Mission in Libya (UNSMIL) to take a clear and responsible stance regarding these repeated transgressions and to refrain from granting any political or practical legitimacy to procedures or outcomes issued outside the framework of constitutional consensus, given the profound impact this has on deepening the crisis and undermining the chances of reaching a sustainable political solution.

The Council stressed that protecting the judiciary and respecting the Constitutional Declaration are not political options subject to compromise or manipulation, but rather a national, constitutional, and moral obligation. Any tampering with them will only exacerbate the chaos and prolong the transitional phase, which the High Council of State categorically rejects.

The General Assembly of the Supreme Court, in a statement issued yesterday, expressed its deep regret and strong condemnation of the position taken by the Speaker of the House of Representatives, Counselor Aguila Saleh, towards the country's judiciary, represented at its highest level, and his attack on the professional reputation of its head, unjustly accusing him and the judiciary of bias and lack of integrity. Describing it as a dangerous precedent.
