Al-Menfi meets a delegation from the Constitutional Drafting Assembly

Tripoli, May 23, 2025 (LANA) - The President of the Presidential Council, Mohamed Al-Menfi, met yesterday, Thursday, in the capital, Tripoli, with a delegation from the Constitutional Drafting Assembly (CDA). The meeting discussed the latest developments in the constitutional process and ways to achieve the constitutional requirement of holding a referendum on the draft constitution.
The Media Office of the Presidential Council reported that during the meeting, the delegation of CDA members emphasized national ownership of the constitutional process, in accordance with national references, and the necessity of respecting the outcomes of the CDA, as a body elected by the people. The CDA's draft constitution was issued in accordance with the provisions of the Interim Constitutional Declaration and its amendments, with a vote rate that exceeded the constitutionally required percentage, which granted it constitutional legitimacy. Furthermore, the draft constitution completed by the CDA has the approval of all institutions involved in the constitutional process.
The media office quoted the delegation of the Commission as confirming that the proposals of the Advisory Committee appointed by the United Nations Support Mission in Libya (UNSMIL) regarding the constitutional process contradict reality and the law. The committee's mandate, according to its mandate, is limited to "preparing options for resolving outstanding issues within the electoral framework." Its mandate does not include submitting proposals regarding the constitutional process or determining the legitimacy or suitability of the draft constitution for a referendum. The draft constitution was prepared in accordance with the provisions of the Constitutional Declaration and has acquired a legal status that is inviolable. Non-binding recommendations issued by an Advisory Committee cannot be equated in legal value with the work of a popularly elected constituent body.
