Libyan Judicial Associations Society Dismiss Candidacy of President of Supreme Council of Judiciary to Political Post.
Pulbished on:Tripoli, 31 January 2021(Lana) The Libyan Judicial Association said it has categorically rejected candidacy of the Head of the Supreme Council of the Judiciary to a political post.
It demanded, in remarks posted to its SMS page, that Councilor Mohamed Al Hafi withdraw his candidacy for an executive post, saying it was a breach of the principle of separation of authorities, and an infringement of the unity of the judicial authority and its neutrality.
The Society called on Al Hafi to hand in his resignation from the Supreme Judicial Council as a first step, if he was keen to carry on with his candidacy, explaining that it is not opposed to a right of any member of the Judiciary to contend for political post provided that he retires or resigns his post in the judiciary.
The Society said one of its goals is to preserve the integrity and independence of the Judiciary, adding that it stands fully against undermining the principle of separation of authorities, and also against adoption of the quota system between the regions.
The society appealed to the High Court General Assembly and the High Council of the Judiciary to convene a meeting to take a firm stance that preserves the independence and integrity of the Judiciary, even if they were compelled to sack the President of the Council if he refused to withdraw his candidacy. It called on the UN Mission to reject candidacy of any incumbent official in the Judiciary.
